In a letter to the Speaker of Parliament Rebecca Kadaga dated 9th August 2013, President Yoweri Museveni confirmed that he had appointed Odoki and requested that he be approved.
"In exercise of the powers vested in the President by Articles 142(1), 143 and 253 of the Constitution of the Republic of Uganda, i have appointed Benjamin Odoki as Chief Justice on a two year Contract. I therefore, forward his name to you for Parliamentary approval," read the President's letter to Kadaga.
Odoki's contract expired early this year when he made it to the mandatory retirement age of 70. However, because of the lack of a "Competent" replacement, President Museveni requested that he should have his contract extended for more two years.
The President's move has been opposed by Civil Society Organisations and other bodies who argue that reappointing an already retired Public servant is a defilement of the Constitutional provisions.
Uganda's Constitution requires that every Public servant should not serve beyond the age of 70 years.
